1. Identification and Purpose

These Terms and Conditions govern access to and use of the website exclusify.es and the real estate intermediation service provided by Exclusify.

The purpose of the service is to connect individuals interested in purchasing a property in Málaga and the Costa del Sol (hereinafter "the User") with verified, specialist local real estate agents (hereinafter "the Agent"), thereby facilitating the property search and purchase process.

Accessing and using the Site implies full and unreserved acceptance of these Terms and Conditions.

2. Description of the Service

2.1 For the User (Buyer)

Exclusify provides the User with an intermediation service that is completely free of charge. The User completes a search form indicating their property preferences. Based on this information, Exclusify selects and assigns a single verified Agent, specialised in the indicated area and search profile, who will contact the User to manage their search.

Exclusify does not act as a real estate agent or as an intermediary in the property transaction. Its role is limited to connecting the User with the Agent. Any contractual relationship arising from the purchase is established exclusively between the User and the Agent or the corresponding agency.

2.2 For the Agent (Agency)

Real estate agents wishing to receive qualified leads through Exclusify must register on the Platform and accept the specific B2B service conditions, which are governed by a separate agreement. Access to the service for agents is subject to a prior verification process carried out by Exclusify.

3. Free Service for the User

The service is completely free for the User. Exclusify is remunerated exclusively by Agents, who pay a fee for each qualified lead they receive. Under no circumstances will any cost be passed on to the User for using the Site or the intermediation service.

4. User Obligations

By using the Site and the service, the User agrees to provide truthful, accurate and up-to-date information in the search form; not to use the Site for fraudulent or illegal purposes; not to impersonate third parties; and to respond to the assigned Agent within a reasonable timeframe.

5. Exclusify's Liability

Exclusify acts as an intermediation platform and is not a party to the relationship between the User and the Agent. Exclusify does not guarantee that the assigned Agent will have the exact property the User is looking for, although it selects Agents specialised in the indicated area and profile. Exclusify is not liable for the acts or omissions of the Agent once the lead has been transferred, nor for damages arising from technical interruptions to the Site or force majeure events.

6. Intellectual and Industrial Property

All content on the Site (texts, images, logos, design, source code and other elements) is the property of Exclusify or its licensors and is protected by Spanish and international intellectual and industrial property legislation. Reproduction, distribution or transformation without the express written authorisation of Exclusify is prohibited.

7. Data Protection

The processing of the User's personal data is governed by Exclusify's Privacy Policy, which forms an integral part of these Terms and Conditions.

8. Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the city of Málaga, without prejudice to the consumer's right to bring proceedings before the courts of their place of residence where applicable under EU law.

9. Amendments

Exclusify reserves the right to amend these Terms and Conditions at any time. Amendments will take effect from the date of publication on the Site. Continued use of the Site following publication of the amendments constitutes acceptance of the same.
